Furnished Holiday Rental Agreement

Le Clos des Collières (hereinafter referred to as “the Owner”)

By accepting these booking terms and conditions and/or paying the booking deposit, the Tenant acknowledges and agrees that this constitutes a signed rental agreement.


Article 1: Duration of Stay

The Tenant, signing this contract for a fixed period, shall under no circumstances claim any right to remain on the premises after the end of the stay.
This contract is a furnished holiday rental agreement, governed by Articles 1709 et seq. of the French Civil Code and Article L.324-1-1 of the French Tourism Code.


Article 2: Conclusion of the Contract

The reservation becomes effective once the Tenant accepts these terms and conditions and pays the Owner a deposit (arrhes) representing 50% of the total rental amount, including tourist tax.
The remaining balance is due upon arrival at the Cottage.

The rental may not, under any circumstances, be partially or fully transferred to third parties (individuals or legal entities) without the Owner’s written consent.
Any breach of this clause will result in immediate termination of the rental at the Tenant’s fault, with all sums already paid remaining fully acquired by the Owner.


Article 3: Cancellation by the Tenant

Any cancellation must be notified by registered letter with acknowledgment of receipt (LRAR).

If the Tenant fails to arrive within 24 hours of the agreed arrival date, the contract becomes void and the Owner may rent out the Cottage.
The total rental amount remains due to the Owner.

If the stay is shortened by the Tenant, the full rental price remains due to the Owner. The Cottage may be made available immediately upon the Tenant’s departure.


Article 4: Cancellation by the Owner

In case of cancellation by the Owner, all sums paid by the Tenant will be fully refunded.

In the event of force majeure (fire, natural disaster, administrative prohibition, or any event making the property uninhabitable), neither party may be held liable for non-performance of the contract.


Article 5: Arrival

The Tenant must arrive on the day and at the time indicated on the Owner’s website.
In case of late or delayed arrival, the Tenant must notify the Owner.


Article 6: Inventory and Condition of Premises

An inventory will be carried out on site by the Owner, in the presence of the Tenant, upon arrival and departure. This inventory constitutes the sole reference in case of disputes regarding the condition of the premises.

The Tenant is responsible for standard maintenance of the premises during the rental period and prior to departure (cleaning appliances, vacuuming floors, washing dishes, emptying the dishwasher, removing bed linens, disposing of trash, etc.).

Standard maintenance differs from the thorough cleaning performed by the Owner between rentals.
If the premises are not properly cleaned, a flat fee of €100 will be charged to the Tenant.


Article 7: Security Deposit

A security deposit of €1000 is required by the Owner.
It may be cashed and returned within one month after the Tenant’s departure, after deduction of any necessary repairs or replacements.

If repair costs exceed the deposit, the Tenant agrees to pay the difference.
Any damage or nuisance caused, whether intentional or accidental, must be compensated by the Tenant.


Article 8: Use of the Premises

The Tenant agrees to use the premises peacefully and in accordance with their intended purpose.
The Tenant shall not intentionally or negligently damage the interior or exterior of the property.
Children remain the full responsibility of accompanying adults.

The Cottage is non-smoking indoors. Cigarette butts must not be discarded on the ground outside.
Food or drink consumption is prohibited on the upper floor of the Cottage.

In accordance with regulations, noise disturbances are prohibited:

Daytime disturbance is also prohibited.
Any disruptive or disrespectful behavior may result in immediate expulsion without refund.

Reference: Articles R.1334-30 and R.1334-31 of the French Public Health Code.
Pets are not allowed.


Article 9: Maximum Occupancy

This contract is for a maximum of 15 persons.
If this limit is exceeded, the Owner may refuse additional persons and declines all liability.


Article 10: Insurance

The Owner holds insurance covering liability for the rental property.
The Tenant must hold civil liability insurance covering any damage they may cause on the premises and provide proof upon request.


Article 11: Payment for Additional Services

The Tenant must pay for any services or amenities used during the stay that are not included in the initial rental price before the end of the stay.


Article 12: Tourist Tax

The tourist tax is calculated at the current rate and must be paid at the start of the stay.
It is collected on behalf of the municipality in accordance with Article L.2333-29 of the French General Code of Local Authorities.


Article 13: Termination for Non-Compliance

Failure to comply with any provision of this contract will result in immediate termination without compensation.
In case of serious misconduct (noise, damage, disrespectful behavior), the Owner may require the Tenant to leave immediately.


Article 14: Jurisdiction

Any dispute regarding the interpretation or execution of this contract falls under the exclusive jurisdiction of the court located in the area of the rental property.
